Welcome to Go Market AI. By accessing or using our platform, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By using Go Market AI, you confirm that you are at least 18 years old and that your use is for lawful business purposes. Your continued use constitutes your acceptance of these Terms.

2. Platform Use

Go Market AI provides tools for AI-driven marketing automation, lead capture, CRM, email, forms, and workflows. You agree to:

Use the platform only as intended and in compliance with applicable laws.

Maintain accurate and up-to-date account information.

Not reverse engineer, copy, or misuse the platform or any third-party integrations.

Ensure that employees, agents, or customers using your account comply with these Terms.

3. Account Ownership

The account is owned by the individual or business entity registering for the platform. In case of disputes, Go Market AI may request documentation to determine ownership. You agree to indemnify Go Market AI against claims arising from account ownership disputes.

4. Privacy and Data

You are responsible for obtaining consent from your users or customers to collect and process personal data.

You must comply with data protection laws such as GDPR, CCPA, and any other applicable privacy regulations.

You are responsible for handling data subject rights requests, data breaches, and proper data retention.

5. Third-Party Services

Go Market AI may integrate with third-party services (e.g., payment processors, email providers, analytics tools).

You are responsible for managing these integrations.

Go Market AI is not liable for the actions, errors, or omissions of third-party services.

6. Security

You are responsible for maintaining the confidentiality of your login credentials and enabling security measures such as two-factor authentication.

Go Market AI is not liable for losses resulting from unauthorized access due to your failure to secure your account.

7. Use of Communication Services

All communications sent through Go Market AI (emails, SMS, calls) are your responsibility. Go Market AI does not control or monitor content sent by you and is not liable for any disputes arising from these communications.

8. Limitation of Liability

Go Market AI is provided “as-is” and is not responsible for:

Any disputes, claims, losses, or damages arising from your use of the platform.

Errors, downtime, or loss of data from third-party integrations.

9. Changes to Terms

Go Market AI reserves the right to update these Terms at any time. Changes are effective immediately upon posting. Your continued use of the platform constitutes acceptance of the updated Terms.

Payment and Taxes

1. Fees and Auto-Renewal

By using Go Market AI, you agree to provide accurate billing information (name, address, payment method, phone number) and notify us of any changes within 10 days. Subscription fees, add-on services, and usage-based fees are billed in advance on a monthly or annual basis depending on your plan.

Your subscription will automatically renew at the current rates unless you cancel. Payment will be charged to your payment method without further authorization.

2. Wallet and Rebilling

Some plans include a wallet feature to pre-load funds for services or automatic rebilling of your customers. Wallet funds are used for all usage-based fees and communication surcharges. If your wallet balance falls below the minimum threshold, your payment method will be automatically charged to replenish the wallet.

Taxes may apply to wallet spending. If a negative balance occurs due to taxes or fees, your payment method will be charged automatically to maintain a positive balance.

3. Late Payments and Payment Disputes

If a payment fails, Go Market AI will attempt to charge your payment method for up to 7 business days. If payment cannot be processed, your account may be suspended or terminated.

Disputes must be reported in writing within 30 days of the invoice. You must pay all fees while the dispute is pending. You agree to cooperate reasonably and in good faith to resolve disputes.

4. Cancellations

You may cancel your subscription through your account or by contacting support. You are responsible for all fees incurred until cancellation. No refunds will be provided for failure to properly cancel services.

5. Mark-Ups and Resale

You may not mark-up or resell Go Market AI services unless your plan allows it. You are responsible for all financial transactions, refunds, and chargebacks with your customers. Go Market AI is not responsible for disputes or payments between you and your customers.

6. Refunds

All fees are non-refundable, including subscription fees, communication surcharges, and third-party services. Pre-paid services, add-ons, and minimum commitment plans are non-refundable. Wallet credits must be requested within 30 days of account cancellation or they will be forfeited.

7. Taxes and Government Assessments

All fees are exclusive of applicable taxes, including sales, VAT, GST, or other government assessments. You are responsible for providing valid tax identification numbers and for remitting all taxes related to your use of the platform. Go Market AI may calculate, collect, and add applicable taxes to your invoice or wallet as legally required.

You are responsible for any withholding or similar taxes. Taxes are non-refundable.
